Contract Disputes

Breach of Contract

What does a breach of contract mean?

In most contracts, there are two or more parties. But the most common would be two. Breaches happen when one of the parties fails to fulfill their duties that are outlined in the terms and conditions of the contract. In most cases, a breach of contract is grounds for a civil or small claims lawsuit. The law will consider any violation of the agreed terms as a breach meaning someone has failed in their part of the initial contract agreement. For breaches of $35,000 or less, you can file in small claims court. It is highly advised you seek the advice of a small claims paralegal to do this as they have the education and experience in small claims court that most do not.

Common Types of Contract Breaches

  • Sales of goods

  • Service delivery

  • Debt obligations

  • Equipment Rentals

  • Commercial Leases

  • Business services

  • Property maintenance

  • Construction projects

  • Employment agreements

Can I Legally Break a Contract?

Contract Review

There are situations where breaching a contract might be considered justified, especially if it's believed that the other party has not fulfilled their obligations. A judge will review the contract to decide if a breach occurred and determine the appropriate consequences.

Filing a Breach of Contract Lawsuit

To pursue a lawsuit, several criteria must be met:

  • The contract must be valid, containing all essential elements.

  • The plaintiff must prove the defendant's breach.

  • The plaintiff must have adhered to the contract's terms throughout.

  • The defendant must have been notified of the breach, preferably in writing, to provide concrete evidence.
