CPP Disability Claim

At Haider Khan Legal, we recognize that many Canadians are familiar with the Canada Pension Plan (CPP) but may become perplexed when it comes to the Canada Pension Plan Disability (CPP Disability). The Canadian government has established a disability program to support those who are unable to work due to disability and have sufficiently contributed to the CPP. Eligibility

To qualify for CPP Disability benefits, individuals must meet specific criteria: they must suffer from a disability that is both "severe" and "prolonged." "Severe" means having a mental or physical disability that consistently prevents one from engaging in any substantially gainful work. "Prolonged" means the disability is long-term, of indefinite duration, or expected to result in death. Additionally, applicants must be under the age of 65 and have met the required CPP contribution thresholds.

 

Contributions to CPP are mandatory for those over 18 who earn more than $3,500 annually. Employed individuals split these contributions with their employers, while self-employed individuals must contribute on their own.

 

Eligibility for the CPP Disability benefit requires contributions to CPP in four of the last six years, or three of the last six years if one has contributed for at least 25 years. Even if you have not made contributions or have very low earnings, you may still qualify under the 'child-rearing provision' if you were the primary caregiver for your children under the age of seven.

 

The government understands that certain circumstances may delay your application due to medical conditions. The 'late applicant provision' allows eligibility for the CPP disability benefit if you were sufficiently contributing to CPP when you first became severely disabled and have been continuously disabled since then.

 

Appeals
