Disobey Red Light

Under section 144(18) of the Highway Traffic Act (HTA), the law stipulates that any driver approaching a traffic light displaying a red signal must bring their vehicle to a complete stop and refrain from proceeding until the signal turns green. It's essential to understand that "stop" means coming to a full and total halt.

As for where to stop, section 144(5) of the HTA mandates that drivers must stop:

  • At the designated stop line or stop sign on the road;

  • Before crossing the crosswalk if there are no road signs or markings present;

  • Before entering the intersection if neither of the above conditions applies.

Failure to adhere to these regulations may result in receiving a red light traffic ticket, constituting a minor liability offense with undesirable consequences.

Penalties for failing to stop at a red light include:

  • Accumulation of 3 demerit points on your driving record;

  • Fines ranging from $200 to $1,000.

  • In cases where a summons is issued, fines can escalate to $1,000 plus court costs.
     

Demerit points remain on your driving record for two years, and a conviction for a red light violation can adversely impact your insurance premiums.

Amber Light Infraction – Failure to Halt

Drivers are often caught off guard when charged for failing to stop at an amber light, believing they can always proceed through it.

​

Section 144(15) of the Highway Traffic Act specifies that when approaching a traffic light displaying an amber signal, drivers must stop if it's safe to do so. If stopping isn't feasible, drivers may cautiously proceed through the amber light.

This ticket presents a greater challenge compared to a red light violation because determining what is "safe" can be subjective. While a driver assesses road and traffic conditions, proximity to the light, and their driving ability, a police officer may have a different perspective.
