Motor Vehicle Accidents

Accident Benefits (SABS)

 

You may qualify for Income Replacement Benefits if you meet any of the following criteria:

  • Employed at the accident time and unable to perform your job's essential tasks within two years post-accident.

  • Unemployed at the accident time, but actively employed for at least 26 weeks in the 52 weeks before the accident, or receiving employment insurance benefits.

  • At least 16 years old or excused from attending school under the Education Act at the accident time, and unable to perform the essential tasks of your most time-consuming employment in the 52 weeks before the accident.

  • Self-employed at the accident time and unable to perform your self-employment's essential tasks within two years of the accident.

 

Income Replacement is calculated at 70% of your gross income, up to $400 per week, unless additional coverage is opted for.

Non-Earner Benefits

Eligibility for Non-Earner Benefits includes:

  • A complete inability to lead a normal life post-accident, without qualifying for income replacement, or

  • Full-time enrollment in education at the accident time, or education completion less than a year before the accident without subsequent employment reflecting your education and training.

  • This benefit starts four weeks post-accident, with weekly payments of $185 or $320, depending on your case.

 

Caregiver Benefits

Housekeeping and Home Maintenance Benefit

Available only for catastrophic injuries or with optional benefits, this supports individuals unable to perform housekeeping and home maintenance tasks as before the accident. Eligible individuals can receive up to $100 per week for life.

 

Attendant Care Benefits

If your injuries prevent you from personal care tasks, you may be eligible for Attendant Care Benefits. These benefits, requiring proof of incurred expense and economic loss by caregivers, have been combined with Medical and Rehabilitation Benefits for a total of $65,000 for non-catastrophic injuries and $1,000,000 for catastrophic injuries.

 

Medical and Rehabilitation Benefits

Covering a wide range of services, these benefits aim for your optimal recovery, with combined totals similar to Attendant Care Benefits, tailored to injury severity and falling under Minor Injury Guidelines when applicable.

 

Death and Funeral benefit

Families can receive death benefits ($25,000 to the spouse, $10,000 to each dependent) and up to $6,000 for funeral expenses, providing crucial financial support during challenging times.

 

Tort Claims

For compensation beyond standard benefits, a tort claim against the responsible party can be pursued for losses including pain and suffering, economic loss, and more.
