Speeding Tickets

Under section 128 of the Highway Traffic Act, all drivers must adhere to the posted speed limits and are prohibited from exceeding them.

You risk receiving a speeding ticket under the following conditions (if speed limit signs are absent):

​

  • 50 km/h in urban areas like cities, towns, and villages.

​

80 km/h in rural or less developed areas.

  • Speeding may not appear severe at first, but the penalties can be quite severe, including fines up to $1,000, up to 6 demerit points, and significantly higher insurance premiums.

​

Note: As of July 1, 2021, changes to the stunt driving law make it crucial to distinguish between simple speeding and more serious offenses.

​Here are the details:

Penalties for Speeding in Ontario:

  • 0 – 6 demerit points;

  • Fines as outlined in the schedule, plus a victim fine surcharge;

  • A speeding conviction remains on your driving record for three years;

  • Possible increase in car insurance premiums with 0 to 3 points for up to three years;

​

Guaranteed increase in insurance premiums with 3 or more points, lasting up to three years or longer, depending on your insurer.

  • While these penalties are not as severe as those for stunt driving, they still impact your driving record and finances due to increased insurance rates.

Important to remember:

  • There are no 1 or 2 demerit point offenses for speeding—only 0, 3, 4, and 6.

  • Speeding 0 – 49 km/hr over the limit will result in a Part I Offence Notice with a preset fine;

  • The same applies to speeding in a Community Safety Zone, though fines are doubled.

  • Speeding by 50 km/h or 35 km/h over the limit in a Community Safety Zone leads to a Part III summons for a court appearance.

  • Convictions leading to 4 – 6 demerit points (speeding 30 km/h+ over the limit) may result in a 30-day license suspension.

Speeding 50 km/h above the limit is considered a major violation affecting insurance rates by at least 100% per year.

  • When contesting speeding tickets, it's essential to understand the speed-measuring device used by the police. To validate the ticket, the officer must fulfill specific requirements before the evidence is considered accurate.

The penalties for speeding in Ontario, effective January 1, 2024, are:

  • 1-15 km/h over the limit: $2.50 per km/h, 0 demerit points

  • 16-19 km/h over the limit: $2.50 per km/h, 3 demerit points

  • 20-29 km/h over the limit: $3.75 per km/h, 3 demerit points

  • 30-49 km/h over the limit: $6.00 per km/h, 4 demerit points

50+ km/h over the limit: requires a court appearance, 6 demerit points

  • Accumulating demerit points can lead to license suspensions and higher insurance costs.

Community Safety Zone Fines:

​

  • 1-15 km/h over the limit: $5.00 per km/h, 0 demerit points

  • 16-19 km/h over the limit: $5.00 per km/h, 3 demerit points

  • 20-29 km/h over the limit: $7.50 per km/h, 3 demerit points

  • 30-49 km/h over the limit: $12.00 per km/h, 4 demerit points

50+ km/h over the limit: requires a court appearance, 6 demerit points

  • Fines in Community Safety Zones are higher to underscore the importance of safe driving near schools, parks, and high pedestrian areas.
